Refugee Category Visas

This visa allows refugees who are persecuted in their home country to resettle indefinitely within Australia.

This visa grants you the following privileges:

  1. To stay in Australia indefinitely.
  2. To work and study in Australia.
  3. To enrol in Medicare, Australia’s public healthcare scheme.
  4. To propose family members for permanent residence.
  5. To travel to and from Australia for 5 years.
  6. To apply for Australian citizenship, if eligible.
  7. To attend free English language classes through the Adult Migrant English Program.

You must be outside of Australia and your country of origin when you apply for this visa.

Eligibility Criteria

This visa includes the following criteria:

  1. You need resettlement because you face persecution in your home country.
  2. You and your family members applying with you must meet the health requirement. Other non-migrating family members may also need to meet this requirement. If you have compassionate and compelling circumstances, your health requirement can be waived.
  3. You must and any family members who apply for the visa with you must meet certain character requirements. Other non-migrating family members may also need to meet this requirement.
  4. Sign the Australian values statement if you are 18 years of age or older, confirming your commitment to respect the Australian way of life and obey Australian laws.
  5. You and your family must have paid back any money owed to the Australian Government or have a formal arrangement in place to repay it.

Inclusion of Other Family Members

When applying for this visa, you have the option to include members of your family unit. You have the option to include them when you submit your visa application or add them afterwards, but it must be before the decision is made.

Family members who apply for the visa must meet specific health and character requirements. Additionally, those family members who do not plan to come to Australia may still be subject to health and character requirements.

Your family includes:

  1. Your partner
  2. Your dependent children
  3. Your partner's dependent children
  4. Other relatives who are dependents (partner, child, parent, sibling, grandparent, grandchild, aunt, uncle, niece, nephew, or cousin)

If your child is not a dependent, then they must apply for their own visa.

Declaration

It's crucial to declare all family members, even those not applying with you.

Note: If you don't declare a family member in your application, proposing them for a refugee and humanitarian visa after arriving in Australia may not be possible.
