Aged Dependent Relative Visa (Subclass 838)

This visa is for an aged individual who would like to relocate permanently to seek relative financial support.

This permanent visa lets a single older person stay in Australia if they rely on a relative living in Australia for financial support. For citizenship purposes, your permanent residence starts on the day the visa is granted.

With this visa you can:

  1. Stay in Australia indefinitely
  2. Work and study in Australia
  3. Enrol in Australia’s public healthcare scheme, Medicare
  4. Sponsor your relatives to come to Australia
  5. Apply for Australian citizenship, if eligible

Eligibility Criteria

To be eligible for the Aged Dependent Visa, you must:

  1. Be sponsored by an eligible relative or their partner, with the sponsorship requiring approval.
  2. Meet the age criterion to receive the Australian age pension, currently increasing from 65 to 67 years.
  3. Demonstrate dependence on your relative in Australia for necessities for at least the last three years before applying, or due to a disabling condition preventing work.
  4. Not have a partner for visa eligibility.
  5. Hold a visa without a "no further stay" condition.
  6. Obtain an Assurance of Support to prevent reliance on government aid upon entering Australia with this visa.
  7. Meet the health requirement for yourself and any applying family members, and potentially other non-migrating family members.
  8. Meet the character requirement, along with your applying family members, and potentially other non-migrating family members.
  9. Repay any debts to the Australian Government or arrange a repayment plan.
  10. Have a clean immigration history without prior visa cancellations or application refusals.
  11. Ensure the visa aligns with the best interests of applicants under 18, as the visa may not be granted otherwise.

Note: You must be in Australia, but not in immigration clearance when you apply and when a decision is made. Likewise, any family members who apply for the visa with you must also be in Australia, but not in immigration clearance, when you apply.

Inclusion of family members

You can include family members in your application or add them before the decision is made. Details of all family members, whether migrating or not, are required in the application form.

Eligible Family Members:

Family members eligible for this visa are your dependent child and stepchild.

  1. Family members applying with you must meet health and character requirements.
  2. Family members not migrating to Australia might also need to meet the health requirements.
