Basic Eligibility

This visa includes the following criteria:

This visa enables employers to address labour shortages by bringing in skilled workers where employers can’t source an appropriately skilled Australian worker.

This visa includes the following criteria:

Medium-term stream

This visa enables employers to address labour shortages by bringing in skilled workers where employers can’t source an appropriately skilled Australian worker.

This visa includes the following criteria:

  1. If you are applying in Australia, you must hold a substantive visa or a Bridging visa A, Bridging visa B or Bridging visa C.
  2. If you are in Australia at the time of decision, you must have substantially complied with any conditions that apply or applied to your last substantive visa or bridging visa held.
  3. Your employer must have nominated you to fill an occupation specified on the Medium and Long-term Strategic Skills List (MLTSSL).
  4. To be eligible for the visa, you must be actively working for your nominating employer, which can be an Australian or Overseas Business Sponsor:

      1. Australian Business Sponsor – You should work in your nominated occupation for either the nominating employer or an associated entity.
      2. Overseas Business Sponsor – Your employment should be in your nominated occupation, specifically for the nominating business only (not an associated entity).

5. If you are the primary visa applicant, you must demonstrate that you have the skills and experience necessary to perform the nominated occupation.

6. You must have at least 2 years relevant work experience in the nominated occupation or a related field.

7. Some primary TSS visa applicants must undergo a mandatory skills assessment as part of the visa application process.

8. You must have adequate health insurance for the whole of your stay to be granted this visa. Your health insurance should cover you for medically necessary treatment, including transport.

9. You and any secondary applicants who apply for a TSS visa must meet the health requirement. The results of health examinations are generally valid for 12 months. Important: You should organise your health examinations upfront before lodging a visa application to reduce processing times.

10. You and family members aged 16 years and over who apply for the visa with you must meet the character requirement. Important: if you are sponsored by an accredited sponsor, you are not required to obtain police certificates from countries other than Australia provided you attach a reference from your accredited sponsor confirming that you are of good character and that you have not been convicted of any criminal offences. You must still, however, provide any required Australian police clearances where applicable or when requested to do so.

11. You must not have engaged in activities related to ‘paying for visa sponsorship,’ which involves seeking, offering, receiving, or providing benefits in connection with sponsorship events, within the past 3 years. Exceptions may be considered at the Minister’s discretion.

12. Primary visa applicants must meet certain minimum standards of English language proficiency unless exemptions apply.

13. Your immigration history is considered, and you may be ineligible if you had a visa cancelled or a previous application refused.

14. You and your family must have paid back any money owed to the Australian Government or have a formal arrangement in place to repay it.

15. Sign the Australian values statement if you and any secondary applicants are 18 years of age or older, confirming your commitment to respect the Australian way of life and obey Australian laws.

Labour agreement stream

This visa is for skilled workers nominated by employers who have a Labour Agreement. It lets you live and work in Australia temporarily. Labour agreements are developed between the Australian Government (represented by the Department) and employers.

Subsequent entrant

This visa is for family members of subclass 457 and TSS visa holders who are applying separately for their TSS visa and wish to join the primary subclass 457 or TSS visa holder in Australia.

This visa includes the following criteria:

  1. You must have a partner or parent who holds a subclass 482 or TSS.
  2. The sponsor with the most recent approved nomination in relation to the primary applicant (or visa holder), must agree (or have agreed) in writing to include you as a family member in the nomination.
  3. You must have adequate health insurance for the whole of your stay to be granted this visa. Your health insurance should cover you for medically necessary treatment, including transport.

How long can I stay in Australia on a temporary skill shortage visa?

The temporary skill shortage visa subclass 482 has 3 different streams, which are granted based on the needs of the employer sponsoring your application. Applications can be for a short-term stream, which is up to 2 years, and medium-term or labour agreement stream, both of which are valid for up to 4 years. 

One of the most basic eligibility requirements for a temporary skill shortage visa is that the application must be sponsored by an approved party who, in most cases, is the employer offering the position that has identified the skill shortage. This sponsorship usually occurs when a non-Australian resident applies and is hired for a position in advance of their travel to Australia.
