Family & Partner Visas

The family stream of the Australian immigration system is designed to reunite Australian citizens and permanent residents with their close family members, or allow Australians a visa that will allow their family member or spouse to remain with them in Australia.

There are many potential visa options that are available for people who are relatives or spouses of Australian citizens or permanent residents, be they fiancés, partners (married or de facto), childrenparents, or certain other family members of Australians.

The majority of visas under the family stream lead directly to permanent residency, though there can be an extended waiting time for certain visas before they are granted.

Family Visa Options for Partners, Children, and Parents

The Immigration Lawyer is here to provide expert guidance and support for anyone wishing to obtain a visa for their partner, child or parent. Applying for a spouse or family visa in Australia can be a long and rigorous process, so it is essential to ensure you have someone by your side to help everything run as seamlessly as possible. Depending on who the visa application is for, it will require one of the following:

Partner Visa (Subclass 820/801)

When applying for a spouse visa in Australia, there is a two-tier process. The Partner Visa enables a spouse or de facto partner to live and work in Australia. To begin, the partner must apply for a Subclass 820 Visa, which allows them temporary residency while processing Subclass 801 for permanent residency. The entire process can take between twelve and twenty-four months to complete and may require a substantial amount of documentation.

Child Visa (Subclass 101/802)

The Child Visa is designed for the children of Australian citizens or those with permanent residency. There are two pathways to take when obtaining a Child Visa, and each one depends on the applicant’s specific situation. The Subclass 101 Child Visa is for children currently living outside of Australia, whereas the Subclass 802 Child Visa is for those already inside the country.

Parent Visa (Subclass 103/804)

The Parent Visa allows parents of Australian Citizens or those with permanent residency to migrate to the country. The two primary options for this visa are Subclass 103, which doesn’t require contributions and can be applied for overseas, and Subclass 804, which allows the parent to apply for the visa whilst in the country.
